Date: Dear Representative ____________________, It is my understanding that House Bill 2041 is slated for vote on February 8, 2010. This House Bill is an Insurance Committee sponsored Bill. House Chairman DeLuca states the Purpose of this Bill is to set Standards for the Towing Industry in Pa. However, I feel that within this legislation is language that will provide insurance companies and their salvage companies the ability to move a consumer’s vehicles without their consent or knowledge. (e) Release of towed vehicle.--A tow truck operator shall not refuse during its posted hours of operation to release a towed motor vehicle upon request from the owner of the vehicle, A PERSON AUTHORIZED BY THE OWNER TO REGAIN POSSESSION, the insurer of the vehicle or a TOWER OR salvor acting on behalf of such an insurer accompanied by tender of cash, credit card from a common issuer or A CHECK FROM AN INSURANCE COMPANY OR AUTHORIZED TOWER OR SALVOR ACTING ON BEHALF OF THE MOTOR VEHICLE OWNER OR insurance company check for towing and storage charges. House Bill 2041 could force an unnecessary delay for consumer’s automobile repairs as it stipulates a tow truck operator must wait 24-hours prior to requesting a repair authorization from the vehicle owner. The majority of vehicles transported in the state are towed for minor repairs such as a battery or tire replacement. It makes no sense to delay the majority of automobile repair services for the sake of the insurance industry’s 24-hour window to unfairly direct consumers to their contracted repair environments. What about lockouts, flat tires and other quick repairs? Is the vehicle owner to wait 24 hours for service? House Bill 2041 is not good legislation for the Commonwealth’s consumers. Those of us who have witnessed the insurance industry’s abusive consumer steering tactics understand exactly what this legislation is intended to do. If this legislation is passed any automobile related business where a consumer’s vehicle is stored or parked whether it is a towing company, auto body shop, auto mechanical garage, or dealership will be subject to releasing the vehicle without their customer’s consent! – Ask yourself, “Who is the property owner?” “Why would a repair business release their customer’s vehicle without the customer’s permission?” Because the insurance companies want to control the consumer’s property. This legislation has easily moved through the House Insurance Committee and it looks like it is heading to the House Floor on Monday, February 8, 2010. Consumers have no idea this is happening. – Please Vote AGAINST House Bill 2041 and safeguard the rights of Pennsylvania Consumers. Sincerely,
